Privacy Policy Statement of Carl Roth GmbH + Co. KG

Welcome to our website. Thank you for your interest in our products and services. We provide a comprehensive service on our website and aim to ensure that your privacy is protected. This is why we want to reassure you that we treat your personal data as confidential and handle it in accordance with statutory data protection regulations and this Privacy Policy Statement. The legal basis for this data protection is the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), the German Telemedia Act (Telemediengesetz, TMG) and the General Data Protection Regulation. The following Privacy Policy Statement gives you, as a visitor to and user of our website, an overview of the situations in which we collect and process your personal data, when we share data with third parties for a certain purpose, and how we use your personal data ourselves. Should we require your consent before processing your data, you will find this in written form below. Once you have given consent, you can revoke this at any time with future effect. The consequences of this revocation are explained below with the respective declaration of consent.
 

1. Subject of the Privacy Policy Statemen

Carl Roth GmbH + Co. KG takes the protection of your personal data very seriously. We want you to know when and what data we collect, and how we use it.

 
2. Controller/service provider

The controller as defined by the German Federal Data Protection Act (BDSG) and the service provider as defined by the German Telemedia Act (TMG) is Carl Roth GmbH + Co. KG (see our Legal notice).


3. Collection and use of your data when you visit our website

When you visit our website for informational purposes you are generally not required to submit any personal data. However, our web server keeps a temporary record of each access to the website and stores this information in a log file. This data is automatically relayed to us by your web browser. From this, we cannot identify which user has accessed which data. The following data record is stored each time a site or file is accessed:
 
  • Name of the files accessed or the page you have visited most recently
  • Date and time of access
  • Volume of data transmitted
  • Access status (file transferred, file not found etc.)
  • The page from which the file was requested
  • A description of the type of web browser you are using and its settings
  • The operating system you are using
  • Your IP address.

This data is collected and used solely in an anonymised form when you visit our website to obtain information. We do this so that you can use the website you have accessed, but also for statistical purposes and to improve our Internet service. We store your IP address only for the duration of your visit. This data is not evaluated with reference to individual persons.


4. Personal data

In some cases, you may be required to submit personal data.

a) What is personal data?
Personal data comprises details concerning the personal or material circumstances of an identified or identifiable natural person. This includes, for example, their name, e-mail address, details of their address and the IP address of the device that they are using. Information that would require a disproportionate effort to identify you or that cannot be used to identify you does not constitute personal data.

b) Contact us
You can contact us via telephone, post or e-mail. Our contact details can be found on the "Contact" page. We request that you submit certain personal data (your full name, company details and your e-mail address), as this enables us to answer your query as quickly and helpfully as possible. In many cases, specifying your request (current requirement, annual requirement, etc.) and your address helps your query to be processed more smoothly. Therefore, you may also want to share these details with us. However, it is your choice whether you do so or not. In every case, we strive to answer your query as helpfully as possible and to your satisfaction, and assure you that we will use your personal data solely for the purpose relating to your query. However, we do reserve the right not to fulfil your request if certain details are not provided that are required in the case in question.

c) Application process
On our website, we offer you the opportunity to apply via e-mail (personal@carlroth.de) for job positions that we are advertising. In so doing, you will normally share personal data with us. By submitting your application, you confirm that the information you have provided is correct. All incorrect information and every deliberate omission may result in rejection or later dismissal.

d) For what purpose is data collected and processed?
Personal data is collected, stored, processed and used only for purposes that are related to your interest in current or future employment within our company and the processing of your application; for example, to contact you or to enable us to decide whether to consider you further in the application process. This data is not passed on to third parties. If your application is successful, the data you have provided may be used for managerial matters during your employment. If you provide personal data during your correspondence with us that is not strictly necessary to make a decision regarding whether an employment relationship is justifiable, or is not required, following this decision, for carrying out or ending this employment relationship, you thereby expressly consent to us storing this data internally and forwarding it to third parties. You can revoke your consent at any time by sending us an e-mail, or by using econda's revocation service, which you can access here. The contact details for this can be found at the end of this Privacy Policy Statement.

e) Who can view my data?
Your application will be processed and perused solely by relevant in-house contact partners. All employees involved in data processing are obligated to respect the confidentiality of your data. Your details are not passed on to third parties under any circumstances. The data is processed solely in Germany. To the extent that we involve external service providers in managing and conducting the application process, we have ensured that these similarly uphold data secrecy and have taken security precautions to prevent unauthorised persons perusing your data, and that they only handle your data on our behalf and according to our instruction.

f) How long will my data be stored?
If we cannot offer you employment, we will keep your data for up to six months for the purpose of answering questions relating to your application and rejection.


5. Use of cookies

As is the case with nearly all Internet sites, our websites use cookies. Cookies are small units of information which your browser automatically stores in your computer's memory. Cookies serve a variety of functions; their main purpose is to improve the user-friendliness of websites. Both we and our external service providers use cookies primarily for analytical purposes. This enables us to analyse and interpret user behaviour to determine how we can improve our websites, so that we can offer you an optimum user experience. Most browsers are preconfigured to automatically accept cookies. You can disable cookie storage or set up your browser so that you are notified before cookies are stored. Users who do not accept cookies may be unable to use certain services on our websites or may be unable to access certain areas of our websites. 6. Use of tracking tools

To ensure the tailored design and optimum performance of this website, solutions and technologies by econda GmbH (www.econda.de) not only collect and store anonymised data, but also utilise this data to compile usage profiles by means of pseudonyms. Cookies can be used for this purpose, making it possible for an Internet browser to be recognised. See Section 5 and our COOKIE POLICY for information on how we handle cookies. However, usage profiles are not compiled using data pertaining to the bearer of the pseudonym without express consent of the visitor. IP addresses, in particular, are rendered indecipherable immediately after receipt, which makes it impossible to match a usage profile with an IP address.


7. Use of other analysis tools

We use various tools on our website in order to analyse and interpret user behaviour on our website and web content to help us in designing our websites in the future. Our websites use Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as "Google"). Google Analytics uses cookies, which are text files that are stored on your computer and make it possible to analyse how you use the websites. The data generated by the cookie about your use of these websites is normally sent to a Google server in the USA, where it is stored. Google analyses the information on our behalf and summarises it in reports, to tell us more about how our websites are being used. Google may also transfer this information to third parties where required by law or insofar as third parties process this data on behalf of Google. We have programmed Google Analytics to anonymise your IP address. This means that your IP address is truncated by Google within member states of the European Union or other states party to the Agreement on the European Economic Area before it is transferred to the Google server in the USA. Therefore, it cannot be traced. Only in exceptional cases is the full IP address sent to a Google server in the USA, where it is truncated. The IP address relayed by your browser within the scope of Google Analytics is not linked to other Google data. You can prevent cookies being stored by configuring your browser software accordingly, but please note that if you do so, you may not be able to use all of this website's functions in full. In addition, you can prevent Google from recording and processing the data generated by the cookie and linked to your use of the website, and you can also prevent the processing of this data by Google by downloading and installing the browser plug-in available via the following link: tools.google.com/dlpage/gaoptout?hl=en. This sets an opt-out cookie which prevents your data from being collected in future when you visit this website. Please note that, should you erase all cookies, the opt-out cookie will also be erased and must be set again if required. 8. Social media links

Our website contains social media links. These are not social plug-ins; they are solely links to Carl Roth GmbH & Co. KG's social media profiles on Facebook, Twitter, Pinterest, YouTube, etc. To the best of our knowledge and in accordance with the declarations of the social media providers, these links do not collect or store any personal data, provided you are not logged in to your social media account and you do not open the link. If you do open one of the links, but are not logged in to the social media network, the log-in screen of the social media network will open in a new window and a cookie from the social media provider will simultaneously be stored on the hard drive of your device. If you are logged in to your account and open the link, our own social media company page will open. There you will find more information about our products and our company. You can leave posts and – depending on your privacy settings – recommend posts to other users. Your browser will also relay specific information, such as your IP address and other information, to the server of the social media provider. The social media provider can record and store this information, assign it to your user account and the personal data stored there, and make it publicly available. In some cases, a cookie from the social media provider is stored on your device in order to record and trace your websurfing behaviour on our websites. Please note that we have no influence on the data collected by each social media provider.

9. Google Maps

Our website contains map material from Google Maps. If you call up a page of our website that contains map material from Google Maps, Google will record, process and use data relating to your use of the map functions. In addition, Google will ask you for your current location in order to show the stores and sales points that are nearest to you on the map (geolocation). 10. Storage period of your data

Insofar as this Privacy Policy Statement does not specify otherwise, we store the data about you, which you make available to us, only for as long as we require it to fulfil the purpose for which you have provided your data or for as long as is required to comply with legal provisions. If you have given your express consent for us to use your personal data for advertising purposes (e.g. subscription to our newsletter), we shall continue to use your data for these purposes, provided you do not revoke your consent. You can revoke your consent with effect for the future at any time.


11. Disclosure of your data

In some situations, it is necessary for us to transmit your data to external service providers, which may also be located in third-countries that are not member states of the European Union. Service providers of this kind could, for example, be commissioned to send out newsletters or other advertising material. All of our external service providers use your personal data solely in compliance with our internal provisions and in accordance with this Privacy Policy Statement, as well as the legal requirements for commissioned data processing. In the event that data is transmitted to service providers in the United States of America, please note that on 12th July 2016, the European Union and the US government reached a political agreement regarding a new framework for the transatlantic exchange of personal data for commercial purposes, known as the "EU-U.S. Privacy Shield" (information about this can be found in the press release and links at http://europa.eu/rapid/press-release_IP-16-2461_en.htm. The EU-U.S. Privacy Shield guarantees the protection of the basic rights of all individuals in the EU whose personal data is transmitted to the USA. According to the information available to us, all service providers used by us that have a registered office in the USA are certified under the EU-U.S. Privacy Shield, meaning that the level of protection achieved in this regard is adequate. Furthermore, we neither share your personal data to third parties without your consent, nor do we sell or lend data. However, we reserve the right to disclose information about you if we are legally obligated to do so, or if lawfully acting authorities or law-enforcement bodies require us to publish this information.


12. Right of access, right to rectification, right to data portability and right to be forgotten

  • In accordance with Article 15 GDPR, you may obtain information about the data concerning you that we are storing, and about its processing, at any time.
  • In line with Article 16 GDPR, you have the right to have incorrect data concerning you rectified without delay.
  • In accordance with Article 17 GDPR, you may at any time obtain the erasure of data concerning you that we are storing.
  • In line with Article 18 GDPR, you may obtain restriction of data processing by us, unless we are not permitted to erase the data due to legal obligations.
  • In addition, you have the right to notification in accordance with Article 19 GDPR. This is relevant if you have exercised your right to rectification, erasure or restriction of processing against the controller. In this case, the controller is obliged to inform all recipients to whom personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves to be impossible or requires a disproportionate amount of time or expense. You have the right to be notified of these recipients.
  • In line with Article 20 GDPR, you have the right to data portability, insofar as you have consented to the processing of data or have concluded an agreement with us.
  • In accordance with Article 7(3) GDPR, you additionally have the right to withdraw consent that you have granted at any time with future effect.
  • In addition, you have the right to lodge a complaint with the responsible supervisory authority at any time, in accordance with Article 77 GDPR. The federal state in which your place of residence or work is situated, or the place of the suspected personal data breach, dictates which supervisory authority is responsible for you. 13. Right to object and right to withdraw
